Terms of Service

1. Acceptance of Terms

By accessing or using Mumuksha (“the Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Platform. We may update these Terms from time to time, and continued use after changes constitutes acceptance.

2. Platform Overview

Mumuksha is a marketplace that connects homeowners with independent service providers. The Platform enables providers to broadcast availability in local areas and homeowners to discover, compare, and book services. Mumuksha does not itself provide any home services.

3. User Accounts

You must create an account to use the Platform. You agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

You must be at least 18 years old to create an account. By registering, you represent that you meet this age requirement.

4. Marketplace Terms

Mumuksha serves as an intermediary marketplace. All service agreements are between the homeowner and the service provider. The Platform facilitates discovery, communication, and scheduling but is not a party to any service contract.

• Homeowners are responsible for accurately describing their service needs.
• Providers are responsible for the quality and timeliness of services rendered.
• Pricing, scope, and terms of individual jobs are agreed upon between the parties.

5. Independent Contractor Classification

Service providers on Mumuksha are independent contractors, not employees, agents, or partners of Mumuksha. Providers control the manner and means of the services they offer. Mumuksha does not direct, supervise, or control provider work.

Providers are solely responsible for their own tax obligations, insurance, licensing, and compliance with applicable laws and regulations.

6. Liability Limitations

To the maximum extent permitted by law:

• Mumuksha is not liable for the quality, safety, legality, or any aspect of services provided by independent contractors on the Platform.
• Mumuksha does not guarantee the availability, reliability, or accuracy of the Platform.
• Mumuksha's total liability shall not exceed the fees you paid to Mumuksha in the 12 months preceding the claim.
• Mumuksha is not liable for indirect, incidental, special, consequential, or punitive damages.

7. Dispute Resolution

If a dispute arises between a homeowner and a provider, the parties should first attempt to resolve it directly. Mumuksha may, at its discretion, offer mediation assistance but is not obligated to do so.

For disputes with Mumuksha, you agree to first contact us at support@mumuksha.com. If unresolved within 30 days, either party may pursue binding arbitration under the rules of the American Arbitration Association.

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against Mumuksha.

8. Cancellation Policies

Cancellation terms for individual bookings are governed by the provider's stated policy. General platform guidelines:

• Homeowners may cancel a pending request at any time before provider acceptance.
• After acceptance, cancellation within 2 hours of the scheduled service may incur a cancellation fee as set by the provider.
• Providers who cancel confirmed appointments may have their reliability score affected.
• Repeated cancellations by either party may result in account restrictions.

9. Prohibited Conduct

• Providing false or misleading information
• Circumventing the Platform to avoid fees
• Harassing, threatening, or discriminating against other users
• Using the Platform for unlawful purposes
• Attempting to reverse-engineer or interfere with Platform operations

10. Account Termination

We may suspend or terminate your account at our discretion for violation of these Terms, fraudulent activity, or for any other reason with notice. You may delete your account at any time through your account settings.

11. Intellectual Property

All content, trademarks, and technology on the Platform are owned by Mumuksha or its licensors. You may not copy, modify, distribute, or create derivative works without written permission.

12. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. Any legal proceedings shall be conducted in the courts of Maricopa County, Arizona.
